1. Purpose
kstr is a platform connecting advertisers (“Brands”) with content creators (“Creators”) who wish to carry out commercial influencer marketing operations. The publisher acts as an intermediary and is not a party to the contracts concluded between Brands and Creators.
2. Registration
Registration is free and reserved for adults and legal entities. Users guarantee that the information they provide is accurate, in particular the audience statistics they declare. Misleading profiles may be suspended.
3. How a collaboration works
A collaboration starts when a Brand accepts an application or a Creator accepts a proposal. The Brand then pays the agreed amount plus service fees. The funds are held until the delivered content is approved, then paid to the Creator minus the commission. If the Brand does not respond within 7 days of delivery, the content is deemed approved.
4. Pricing
Service fees charged to Brands depend on their plan (Starter: 10%, Pro: 7%, Business: 4%). A commission of 5% is deducted from Creators’ earnings. Subscriptions and options (boost) are paid in advance for a fixed period and are not renewed automatically. Prices exclude VAT.
5. Influencer marketing obligations
The parties undertake to comply with the laws applicable to influencer marketing in their country, and in France with Law No. 2023-451 of 9 June 2023, in particular: clearly labelling every sponsored content as “Advertising” or “Commercial collaboration”, not promoting prohibited products and services, and signing a written contract when the amount exceeds the threshold set by decree. The brief and the messages kept on the platform can serve as a basis for that contract.
6. Non-circumvention
6.1 Principle. Any introduction between a Brand and a Creator made through kstr (viewing a profile or a campaign, an application, a message, a collaboration proposal) commits both parties to conclude and pay on the platform any collaboration that results from it. This commitment applies for as long as the service is used and for 12 months after the parties’ last exchange on the platform.
6.2 Prohibited practices. The following are in particular considered an attempt at circumvention:
- offering, requesting or accepting payment outside the platform for a collaboration initiated on it;
- sharing or asking for contact details (email, phone number, messaging app, social media account, payment link or details) before the first payment, in order to continue outside the platform;
- disguising a collaboration (gift, invoice for another service, splitting the amount) to avoid the service fee or commission;
- encouraging the other party to leave the platform, or using another account to get around a restriction.
6.3 Sanctions. Depending on the seriousness and repetition of the facts, and after reviewing the information available, the publisher may: issue a warning; temporarily suspend the account; permanently ban the user from the platform, which closes the account and prohibits signing up again under any identity, email address or entity. In the event of suspension or ban, current subscriptions and options are not refunded. Amounts owed to a Creator for collaborations properly completed on the platform are still paid. The publisher also reserves the right to claim compensation for the loss suffered, in particular the service fees and commissions avoided.
6.4 Reporting. Any user who receives a circumvention proposal, or who is the victim of one, must immediately inform the site administrators at hi@joinkstr.com, attaching a screenshot or the link to the conversation where possible. A user who reports in good faith a request they did not act on faces no sanction. Reports are handled confidentially.
6.5 Protective measures. Contact details are hidden in the messaging system until the first payment of a collaboration between the parties. In the event of a report or serious suspicion of circumvention, the kstr team may review the conversations concerned, solely to verify the facts.
7. Disputes between users
If there is a disagreement, either party can open a dispute. The kstr team reviews the messages and the delivered content and decides in good faith whether to release the funds to the Creator or refund the Brand, in whole or in part.
8. Right of withdrawal
Services provided to professionals do not carry a right of withdrawal. For consumers, a service fully performed before the end of the withdrawal period with their express consent (a boost activated immediately) waives that right.
9. Liability
The publisher makes reasonable efforts to keep the service available but does not guarantee campaign results or the accuracy of statistics declared by Creators.
10. Governing law
These terms are governed by French law. Failing an amicable settlement, the courts with jurisdiction over the publisher’s registered office shall have jurisdiction, subject to mandatory rules protecting consumers, who may also use a consumer mediator free of charge.
